General Terms and Conditions of Sale (GTCS)

These General Terms and Conditions of Sale (GTCS) define the terms and conditions of sale for the services offered by Digipark through its mobile application available on Google Play and the App Store. They complement the General Terms and Conditions of Use (GTCU) and are accepted without reservation by the user upon purchasing services.

2.1 Services Offered

DigiPark is a digital medical device designed to support patients with Parkinson's disease, intended to collect, analyze, and display health and real-life data. It allows patients to holistically manage their health status and quality of life through continuous monitoring of health and real-life data.

Free Offer

The Digipark application offers free access to some basic features.

Paid Offer

The paid offer includes:

• Unlimited messaging access with a healthcare professional.
• A complete PDF report to share with healthcare professionals or other interested parties.

This offer is available at:

• €19.99/month for a monthly subscription.
• €199.99/year for an annual subscription, equivalent to €16.66/month, with 2 months free.

3.1 Prerequisites

Access to the Digipark application requires an internet connection, a smartphone, or a tablet compatible with the following minimum configurations:

Network Characteristics

• Minimum requirements: internet connection with latency below 150 ms and bandwidth above 100 kbps
• Recommendations: internet connection with latency below 50 ms and bandwidth above 1 Mbps
• Firewall enabled: Digipark and DiamPark - Home domains on port 443
• For information: all communications between DiamPark applications/servers are secured in SSL/TLS port 443

Operating System (OS)

• On Android: OS version 7.0 or higher.
• On iOS: OS version 14 or higher.
• The following operating systems are not compatible: Windows phone mobile and Blackberry OS.

Mobile Devices

• All the following devices are compatible: all smartphones that support BLE (Bluetooth Low Energy), with internet connectivity, a compatible operating system, and sufficient processing power and memory.

Wearable Product in Combination with the Medical Device

• Smartwatch model available on the Store.

3.2 Account Creation

To access the services, the user must create an account by providing accurate and up-to-date information. The necessary information includes first name, last name, email address, and phone number. The user must be at least 18 years old or have the authorization of their legal representative.

3.3 Credentials

Login credentials (email, phone number, password) are personal and confidential. In case of unauthorized or suspicious use, the user must immediately notify Digipark at support@digipark.io.

3.4 Account Security - Responsibility

The user is responsible for the security of their account and must take necessary measures to prevent unauthorized access. Digipark declines all responsibility in case of fraudulent use of the account.

4.1 Prices

Service prices are indicated on the Digipark website and on the Google Play and App Store platforms. They may be changed at any time. Price changes will be communicated to users by email or through the application.

4.2 Payment

Service payment is made through the Google Play and App Store platforms. The payment terms are those defined by these platforms. By making a purchase, the user accepts the sales conditions of Google Play or the App Store.

4.3 Billing

Once the payment is made, a purchase confirmation will be sent to the user by Google Play or the App Store. Digipark does not issue a separate invoice for purchases made through these platforms.

All content of the application, including texts, graphics, images, logos, is the exclusive property of Digipark or its partners and is protected by intellectual property laws. The user has a limited, personal, non-exclusive, and non-transferable license to access and use the application in accordance with the GTCU and GTCS.

6.1 Application Operation

Digipark strives to ensure the proper functioning of the application. However, Digipark cannot be held responsible for service interruptions due to technical problems, maintenance operations, or necessary updates.

6.2 Content

The content of the application is provided for informational purposes and does not replace the advice of a healthcare professional. Digipark declines all responsibility regarding the accuracy and completeness of the information provided.

7.1 Processing and Purposes

Digipark processes users' personal data in accordance with its privacy policy, respecting the current personal data protection laws. The collected data is used to provide services, improve the application, and ensure users' security.

7.2 Users' Rights

Users have the rights to access, rectify, delete, and oppose the processing of their personal data. To exercise these rights, users can contact Digipark at rgpd@digipark.io.

Digipark reserves the right to modify these GTCS at any time. Modifications will be notified to users by email or through the application. Continued use of the services after notification of the modifications constitutes acceptance of the new GTCS.

These GTCS are governed by French law. In case of dispute, the parties will strive to find an amicable solution before resorting to the competent courts of the Court of Appeal of Paris.

10.1 Invalidity of a Provision

If one or more provisions of these GTCS are held to be invalid or declared as such in application of a law, regulation, or following a final decision of a competent court, the other provisions will retain their full force and effect.

10.2 Integration of the GTCU

These GTCS integrate and complement the General Terms and Conditions of Use (GTCU) of Digipark. In case of contradiction between the GTCS and the GTCU, the provisions of the GTCS will prevail.
