These General Terms of Use (hereinafter "TOU") are intended to define the terms and conditions of use of the Digipark mobile application (hereinafter "the Application"), published by DiamPark SAS (hereinafter "DiamPark" or "the Publisher").

The Digipark Application is a Class I digital medical device, CE marked in accordance with Regulation (EU) 2017/745 on medical devices (MDR). It is intended for patients with Parkinson's disease and their caregivers.

Use of the Application implies full and unreserved acceptance of these TOU. If you do not accept these conditions, please do not use the Application.

The Digipark Application is a daily monitoring tool for patients with Parkinson's disease. It offers the following features:

• Smart pillbox: treatment reminders and compliance tracking
• Symptom journal: daily assessment modules (mood, mobility, sleep, pain)
• Activities and well-being: physiotherapy exercises, adapted activity programs and therapeutic education
• Passive monitoring via connected smartwatch (optional)
• Secure data sharing with healthcare professionals via Digipark 360

The Application is not a substitute for professional medical advice. It provides no diagnosis, prescription or therapeutic recommendation.

4.1 — Access Conditions

The Application is available for free on Apple App Store (iOS) and Google Play Store (Android). Downloading and using the Application requires a compatible device and an Internet connection.

4.2 — Account Creation

Use of the Application requires the creation of a user account. The User agrees to provide accurate, complete and up-to-date information upon registration. They are responsible for the confidentiality of their login credentials.

4.3 — Age Requirements

The Application is intended for adults (18 years and older). Use by a minor must be done under the responsibility of their legal representative.

5.1 — Data Controller

DiamPark SAS is responsible for processing personal data collected via the Application, within the meaning of Regulation (EU) 2016/679 (GDPR) and Law No. 78-17 of January 6, 1978 as amended.

• Identification data: name, first name, email address, date of birth
• Health data: declared symptoms, treatments, compliance, sensor data (via smartwatch), quality of life questionnaires
• Technical data: device type, OS version, connection logs

5.2 — Data Collected

The Application collects the following categories of data:

5.3 — Health Data Hosting

Health data is hosted by a certified HDS (Health Data Host) in accordance with the provisions of Article L.1111-8 of the Public Health Code.

5.4 — Purpose of Processing

Data is processed for the following purposes: provision of the monitoring service, improvement of care, communication between the patient and their care team, and clinical research (only with explicit consent and anonymized data).

5.5 — User Rights

In accordance with the GDPR, you have the following rights: access, rectification, erasure, restriction, portability, opposition. To exercise these rights, contact: support@diampark.io.

All elements composing the Application (texts, graphics, software, images, sounds, videos, databases, algorithms, etc.) are the exclusive property of DiamPark SAS or its partners and are protected by the provisions of the Intellectual Property Code.

Any reproduction, representation, modification, publication, transmission, or more generally any unauthorized exploitation of all or part of these elements is prohibited and constitutes an infringement sanctioned by articles L.335-2 et seq. of the Intellectual Property Code.

The Digipark Application is a Class I medical device within the meaning of Regulation (EU) 2017/745 (MDR). It is CE marked.

The Application does not replace a doctor's advice. It is not intended to diagnose, treat or cure any pathology. It only provides information and monitoring tools.

Please read the instructions for use (e-IFU) carefully before using the Application.

8.1 — Publisher's Liability

DiamPark uses all reasonable means to ensure continuous and quality access to the Application. However, DiamPark cannot be held responsible for service interruptions due to maintenance operations, updates, force majeure or problems beyond its control.

8.2 — User's Liability

The User is solely responsible for their use of the Application and the data they enter. They agree to use the Application in accordance with its purpose and these TOU.

DiamPark reserves the right to modify these TOU at any time. Modifications take effect upon publication in the Application. The User will be informed of any substantial modification. Continued use of the Application after notification constitutes acceptance of the modified TOU.

The User can stop using the Application at any time by deleting their account from the Application settings or by contacting support@diampark.io. Deletion of the account leads to the permanent deletion of the User's personal data, subject to legal retention obligations.

These TOU are governed by French law. Any dispute relating to the interpretation or execution hereof will be submitted to the competent courts of Paris, after an attempt at amicable resolution.
